The absence of a private cause of action in first-party property claims leaves policyholders vulnerable to unfair practices by insurance companies. It weakens consumer protection, reduces the accountability of insurers, and limits the ability of individuals to seek timely and adequate redress for their grievances. Adding a private cause of action would empower policyholders to take legal action directly and could lead to more equitable outcomes in disputes with insurance companies.
