Our rapidly changing climate is increasing the frequency and severity of extreme weather events. As more New York homeowners and businesses file claims due to hurricanes, floods, and other disasters, the risk of insurers delaying, underpaying, or wrongfully denying claims grows. Without the ability to sue for bad faith, policyholders are left vulnerable, often facing prolonged delays and inadequate settlements. As these challenges rise, insurance carriers and their lobbyists are likely to intensify efforts to oppose measures that would hold them accountable. Now is our best opportunity to pass good common sense legislation that protects the rights of disadvantaged consumers.
A private cause of action would hold insurers accountable, deterring unfair practices and ensuring timely, fair payouts when they are most needed. This legal tool would provide faster resolution for claims, promote equitable recovery for disproportionately affected communities, and create a stronger incentive for insurers to handle claims honestly as climate-related risks grow.
